Welcome to Kiras Art. By accessing and using our website kirasartitaly.com, you agree to these Terms & Conditions. Please read them carefully before making a purchase. These Terms apply to all visitors, users, and buyers of Kiras Art, including purchases of artworks, prints, or other products offered on the site.
1. Orders
All orders are subject to availability. When placing an order, the buyer confirms that they are authorized to use the payment method provided. Kiras Art reserves the right to refuse or cancel any order for reasons including, but not limited to, stock unavailability, suspicion of fraud, or technical errors. The contract is concluded when Kiras Art sends an order confirmation email.
2. Products
Kiras Art offers original artworks and limited edition pieces. Each item is handcrafted and may slightly vary in color, texture, or dimensions compared to images on the website. The buyer acknowledges that handmade works may present minor differences from the digital preview. All artworks are created in Kiras Art’s studio in Milan, using professional equipment and techniques to ensure quality and fidelity to the original design.
3. Pricing
All prices are shown in Euro (€) and include VAT for buyers in the EU, unless otherwise specified. Prices are subject to change without prior notice, but the price at the moment of order confirmation will be honored. Any applicable shipping charges will be calculated and displayed during the checkout process.
4. Payment Methods
Payments are securely processed via third-party providers such as PayPal or major credit/debit cards. Kiras Art does not store payment information on its servers. Orders will only be processed after successful payment authorization. In the event of failed payment, the order will not be confirmed and will remain pending until resolved.
5. Shipping
Kiras Art ships worldwide from Milan. Shipping costs depend on the destination country and product shipping tier (Shipping Tier 1 or Shipping Tier 2). Each product is assigned a shipping tier according to size, weight, and fragility.
Shipping Rates by Country
- Italy: Shipping Tier 1 = €7, Shipping Tier 2 = €15
- France, Germany, Spain, Belgium, Netherlands, Austria, Portugal: Shipping Tier 1 = €10, Shipping Tier 2 = €20
- Other countries: rates available on request
Multiple Products Calculation
For orders including multiple products, shipping cost is calculated as follows:
- Take the highest shipping rate among all products in the order.
- Add 50% of the shipping cost for each additional product in a lower shipping tier.
Delivery Conditions
Delivery times are indicative: generally 5–7 business days for Italy, 7–14 days for other European countries, excluding holidays. Delays may occur due to force majeure, traffic, customs, or postal restrictions. Deliveries are made during business hours (9:00–17:00, Monday–Friday, excluding holidays). If the recipient is absent or the address is incorrect, the buyer is responsible for additional storage or re-delivery charges as applied by the carrier.
Tracking
After shipment, buyers will receive a tracking number via email. Tracking allows real-time monitoring of the delivery status. Buyers are advised to inspect packages upon receipt. Any visible damage must be noted on the delivery document (e.g., “package damaged, contents shifted”) to claim insurance coverage.
6. Risk of Loss & Damaged Goods
All products travel at the buyer’s risk until delivery. If damage is detected upon delivery, accept the package with reservation and indicate the damage on the delivery receipt. Insurance claims are only valid if damage is documented at delivery. Kiras Art will replace lost or damaged products, or propose equivalent alternatives. Buyers can refuse replacements and request a credit note.
7. Returns & Right of Withdrawal
European consumers have the right to withdraw from the contract within 14 days from the date of receipt. Personalized or custom artworks are exempt from withdrawal.
To exercise this right, buyers must notify Kiras Art via email (info@kirasart.it).
Returned products must be sent adequately packaged to the address: KIRAS ART — Monica Mangiavacchi, Via Derna 19, 20132 Milano (MI).
Refunds are issued within 14 days using the same payment method as the original transaction. The refund may be delayed until the returned product is received or proof of shipment is provided. Buyers are responsible for shipping costs of returned items and any reduction in value due to handling beyond what is necessary to assess the nature and characteristics of the product.
8. Ownership
Ownership of products remains with Kiras Art until full payment is received. Only after payment is completed, the buyer legally owns the artwork.
9. Intellectual Property
All content on the website, including images, designs, and text, is protected by copyright and intellectual property laws. No content may be copied, reproduced, or distributed without written consent from Kiras Art.
10. Limitation of Liability
Kiras Art is not liable for indirect, incidental, or consequential damages, including lost profits, loss of data, or interruptions of service, except in cases of gross negligence or willful misconduct.
11. Privacy
Personal data is collected and processed in accordance with our Privacy Policy. By using this site, buyers consent to the collection and processing of their data as described.
12. Consumer Protection & Online Dispute Resolution
In compliance with EU Regulation 524/2013, buyers can access the Online Dispute Resolution (ODR) platform: https://ec.europa.eu/info/policies/consumers_en. Kiras Art encourages amicable resolution before engaging formal proceedings.
13. Governing Law
These Terms & Conditions are governed by Italian law. Disputes are subject to the jurisdiction of the courts of Milan, Italy, unless otherwise required by law for European Consumers.
14. Updates
Kiras Art reserves the right to update or modify these Terms & Conditions at any time. Continued use of the website constitutes acceptance of the updated terms.
